The constitutions of some states have been interpreted by courts to impose a heightened level of scrutiny upon the state government’s claim that it can’t provide an accommodation from a generally applicable law to a religious person. In this way, this standard acts much like a state RFRA to secure religious accommodations.

Some states have a Religious Freedom Restoration Act (“RFRA”), which are modeled off a federal law with the same name. These laws provide a general religious accommodations from otherwise generally applicable laws, but only if the religious person’s exercise of religion is substantially burdened and the government’s purpose behind the law isn’t compelling or the government has another way to accomplish the law’s purpose.
